Liability

Unless otherwise agreed with us, we shall only be liable for such damages, in accordance with the following provisions, which were caused either by wilful intent or the gross negligence of our legal representatives or senior executives, or as a result of potentially severe organisational misconduct, irrespective of the legal grounds; we shall also be liable for damages following the culpable violation of fundamental contractual obligations. In the event of a violation of fundamental contractual obligations, liability shall be limited to damage which may typically occur.

Our liability shall be fully excluded in the case of slight negligence, insofar as this is legally permitted. In any case, this exclusion shall apply to indirect damages.
